代理人（nominee）也叫經紀人或“授權代表”，指自然人根據代理契約或授權書或口頭約定，向被代理者收取一定佣金（或者免費），全權或在一定的授權範圍內，代表被代理人或者授權單位，在代理期限內行使被代理者的權力，完成相關的使命或者任務。代理人需有被代理人或授權單位的書面授權、一定的資格和相關的技能等，代理人依其代理物件之多寡可分為專屬代理人與普通代理人。
