押金，是一方當事人將一定費用存放在對方處保證自己的行為不會對對方利益造成損害，如果造成損害的可以以此費用據實支付或另行賠償。在雙方法律關係不存在且無其他糾紛後，則押金應予以退還。在違約時將會被扣除。 押金具有替代性，一般是在一方已為另一方遞交實質性的標的物，為保證已交付的標的物能返還，要求另一方交付相當金額的保證金，在合同不能履行時，以沒收押金作為解決合同的方式，體現保護非交付押金一方的利益。 押金，實務中也稱保證金，風險抵押金等。是指當事人雙方約定，債務人或第三人向債權人給付一定的金額作為其履行債務的擔保，債務履行時，返還押金或予抵扣；債務不履行時，債權人得就該款項優先受償。給付押金的人，稱出押人，一般就是債務人或第三人。受領押金的人，稱受押人，他是債權人。
