　　美國《憲法》不僅確定聯邦政府的結構和權力，而且也對州政府有基本規定。同時，各個州也都有州憲法;州憲法包含針對州內地方政府的條文。地方政府是指市、縣、鎮或學區以及特別選區的政府。地方政府負責管理當地的自然資源或交通系統。

　　聯邦政府的權力和職責範圍由《合眾國憲法》 限定。屬於聯邦政府的權力包括：州際貿易、國防、造幣、移民及入籍、以及與外國簽定條約等。

　　地方政府的結構和權力由州憲法確立。如同州政府的規定不得與聯邦法律相悖一樣，地方政府受到州憲法和法律的制約。
