預約，即“約定將來訂立一定契約的契約”。通常，人們把將來要訂立的契約稱為本約，而以訂立本約為其標的合同便是預約。按照私法自治原則，當事人享有廣泛的合同自由，包括是否訂立合同、與誰訂立合同、訂立什麼樣內容與形式的合同的自由等。預約，無疑是對與誰和就何種事情訂立合同等作出預先安排，這似乎是對當事人合同自由進行了限制，實質上卻把合同自由運用到極至。
